1 Kabul Edilme ve Taraflar

İşbu Kullanım Koşulları, OSAI platformunu (osai.com.tr) kullanırken uymanız gereken kuralları belirler. Platformu kullanarak, bu koşulların tamamını kabul ettiğinizi ve platformun sahibi olan Octopus Software A.Ş. ("Şirket") ile yasal olarak bağlayıcı bir sözleşme akdettiğinizi kabul edersiniz.

18 yaşından küçüklerin platformu tek başlarına kullanmaları yasaktır. Platformu bir kurum veya şirket adına kullanıyorsanız, ilgili kurumu bu koşullarla bağlayıcı kılacak tam yetkiye sahip olduğunuzu beyan ve taahhüt edersiniz.

2 Hizmet Tanımı

OSAI, kullanıcıların yapay zeka araçları kullanarak sosyal medya hesapları (Instagram, Facebook, X, LinkedIn, TikTok, Threads, vb.) için içerik, metin ve görsel üretmesini, bu içerikleri planlamasını ve otomatik olarak yayınlamasını sağlayan bulut tabanlı (SaaS) bir platformdur.

Şirket, sunulan hizmetleri geliştirme, değiştirme veya bazı özellikleri sonlandırma hakkını saklı tutar.

3 Hesap Güvenliği ve Kayıt

Platformdan yararlanabilmek için e-posta adresinizle kayıt olmanız ve şifre belirlemeniz gerekmektedir. Oluşturduğunuz hesabın güvenliğinden tamamen siz sorumlusunuz.

• Şifrenizi üçüncü kişilerle paylaşmamanız gerekmektedir.
• Hesabınızda izinsiz bir erişim fark etmeniz durumunda derhal info@octopussoftware.com adresine bildirimde bulunmalısınız.
• Doğru ve güncel bilgi vermeyi kabul edersiniz. Yanıltıcı bilgilerle hesap açılması durumunda hesabınız askıya alınabilir.

4 Kullanım Kuralları ve Sınırlamalar

OSAI platformunu kullanırken aşağıdaki yasaklara uymayı taahhüt edersiniz:

• Yürürlükteki yasalara aykırı, telif haklarını ihlal eden, nefret söylemi, müstehcenlik, terör propagandası veya şiddet içeren paylaşımlar üretmek ve yayınlamak.
• Platformu otomatik botlar, web scrapers veya platformun işleyişini engelleyecek araçlarla manipüle etmeye çalışmak.
• Sistem kaynaklarını aşırı tüketecek şekilde kötüye kullanım gerçekleştirmek.
• Diğer kullanıcıların hesaplarına yetkisiz erişim teşebbüsünde bulunmak.

Kural ihlali durumunda Octopus Software, kullanıcı hesabını önceden bildirimde bulunmaksızın askıya alma veya kalıcı olarak silme hakkına sahiptir.

5 Fikri Mülkiyet Hakları

OSAI platformunun tasarımı, yazılımı, logoları, algoritmaları ve tüm tescilli içerikleri Octopus Software A.Ş.'ye aittir. İzinsiz kopyalanamaz, çoğaltılamaz veya tersine mühendislik işlemlerine tabi tutulamaz.

Kullanıcı olarak platform üzerinden ürettiğiniz içeriklerin mülkiyeti size aittir. Ancak içeriklerin yayınlanması ve platformun işlevini yerine getirmesi amacıyla Octopus Software'e bu içerikleri barındırma, işleme ve yayınlama lisansı vermiş olursunuz.

6 Üçüncü Taraf Sosyal Medya Entegrasyonları (Meta, TikTok, vb.)

OSAI, içeriklerinizi yayınlamak için Meta (Facebook & Instagram), TikTok, X, LinkedIn gibi platformların resmi API altyapılarını kullanır. Platformumuzu kullanarak bu sosyal ağ hesaplarını OSAI'ye bağladığınızda, ilgili üçüncü taraf platformların kendi kullanım koşullarını ve gizlilik politikalarını da kabul etmiş olursunuz.

7 Ödeme, Abonelik ve İptal Koşulları

OSAI abonelik bazlı ücretli planlar sunmaktadır. Ödemeler aracı ödeme kuruluşu (PayTR) üzerinden güvenli altyapıyla tahsil edilir.

• Seçtiğiniz paket, paket süresi sonunda aksi belirtilmedikçe otomatik olarak yenilenir.
• Aboneliğinizi dilediğiniz zaman fatura kesim tarihinden önce Ayarlar sayfasından iptal edebilirsiniz.
• İptal edilen aboneliklerde, içinde bulunulan dönem için kısmi ücret iadesi yapılmamaktadır.

8 Sorumluluk Reddi ve Garanti Sınırları

OSAI platformu "olduğu gibi" ve "kullanıma hazır olduğu şekliyle" sunulmaktadır. Octopus Software, platformun tamamen kesintisiz, hatasız olacağını veya AI üretimli içeriklerin her zaman kusursuz sonuç vereceğini garanti etmez.

Sosyal medya platformlarının (Meta, TikTok vb.) kendi API'lerinde veya kurallarında yapacakları değişiklikler nedeniyle yaşanabilecek erişim kesintilerinden Octopus Software sorumlu tutulamaz.

9 Tazminat ve Hak Talepleri

Platformu kullanımınızdan veya işbu şartların ihlalinden kaynaklanan her türlü hukuki, cezai ve mali sorumluluk doğrudan size aittir. Şirketi, çalışanlarını ve ortaklarını bu tür üçüncü taraf iddialarından ari tutmayı ve doğabilecek zararları tazmin etmeyi kabul edersiniz.

10 Yürürlük ve Değişiklikler

Bu Kullanım Koşulları, yayımlandığı tarihten itibaren geçerlidir. Octopus Software, koşulları dilediği zaman güncelleme hakkını saklı tutar. Güncellemeler bu sayfa üzerinden duyurulacaktır. Değişikliklerden sonra platformu kullanmaya devam etmeniz, yeni şartları kabul ettiğiniz anlamına gelir.

11 Yetkili Mahkeme ve Hukuk

Bu sözleşmenin uygulanmasında ve yorumlanmasında Türkiye Cumhuriyeti Kanunları geçerlidir. Sözleşmeden doğacak her türlü ihtilafta İstanbul Çağlayan (Merkez) Mahkemeleri ve İcra Daireleri yetkilidir.

1 Acceptance and Parties

These Terms of Service define the rules you must follow when using the OSAI platform (osai.com.tr). By accessing or using the platform, you agree to be bound by these terms in full and enter into a legally binding contract with Octopus Software A.Ş. ("Company", "we"), the owner of the platform.

Users under the age of 18 are prohibited from using the platform on their own. If you are using the platform on behalf of a legal entity, you declare and warrant that you have full authorization to bind that entity to these terms.

2 Description of Service

OSAI is a cloud-based Software-as-a-Service (SaaS) platform that allows users to use AI tools to generate, schedule, and automatically publish content, texts, and images for social media accounts (including Instagram, Facebook, X, LinkedIn, TikTok, Threads, etc.) and websites.

The Company reserves the right to develop, modify, or discontinue any features of the service at any time.

3 Account Security and Registration

To use the platform, you must register with a valid email address and choose a password. You are entirely responsible for maintaining the security of your account and credentials.

• You must not share your password with third parties.
• If you suspect any unauthorized access to your account, you must immediately contact us at info@octopussoftware.com.
• You agree to provide true, accurate, and current information. Registration with misleading information may result in the suspension of your account.

4 Rules of Conduct and Limitations

You agree not to engage in any of the following prohibited activities while using OSAI:

• Generating or publishing content that violates applicable laws, infringes third-party copyrights, or contains hate speech, obscenity, violence, or promotional material for illegal acts.
• Attempting to manipulate the platform using automated bots, web scrapers, or other tools that block or restrict platform operations.
• Misusing system resources in a manner that causes excessive server load.
• Attempting unauthorized access to other user accounts.

In the event of a breach of these rules, Octopus Software reserves the right to suspend or permanently delete the user's account without prior notice.

5 Intellectual Property Rights

All designs, software, logos, algorithms, and registered content of the OSAI platform belong to Octopus Software A.Ş. They may not be copied, reproduced, or reverse engineered without permission.

As a user, you own the content you generate. However, by using the service, you grant Octopus Software a license to host, process, and publish this content to the extent necessary to provide the services.

6 Third-Party Social Media Integrations (Meta, TikTok, etc.)

OSAI connects to official API frameworks of platforms such as Meta (Facebook & Instagram), TikTok, X, and LinkedIn to publish your content. By connecting these social accounts to OSAI, you agree to comply with the terms of service and privacy policies of these third-party platforms.

7 Payment, Subscription, and Cancellation

OSAI offers subscription-based paid plans. All payments are securely processed through our third-party payment gateway provider (PayTR).

• Subscriptions automatically renew at the end of each billing cycle unless cancelled.
• You can cancel your subscription at any time before the billing date in the Settings panel.
• No partial refunds are issued for the remaining days of an active billing cycle upon cancellation.

8 Disclaimers and Limitations of Warranty

OSAI platform is provided "as is" and "as available". Octopus Software does not guarantee that the service will be uninterrupted or error-free, or that the AI-generated results will be completely accurate or fit for a specific purpose.

We are not liable for any service interruptions caused by modifications, outages, or rules changes made by third-party social media platforms (Meta, TikTok, etc.) to their API configurations.

9 Indemnification

You agree to indemnify and hold harmless Octopus Software A.Ş., its employees, and affiliates from any third-party claims, damages, liabilities, or expenses arising out of your use of the platform or your violation of these Terms of Service.

10 Validity and Modifications

These Terms of Service are effective as of the date of publication. Octopus Software reserves the right to modify these terms at any time. Changes will be posted on this page. Your continued use of the platform following the posting of changes constitutes acceptance of those changes.

11 Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Republic of Turkey. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the Courts and Execution Offices of Çağlayan, Istanbul.
